New Guideline by SECO regarding Intra-Group Hiring of Services

The Swiss State Secretariat for Economic Affairs SECO, the Federal authority supervising the execution of the laws regulating the hiring of services by the Cantonal Labour Authorities, has issued a new guideline detailing the licensing requirements for intra-group hiring of services (Konzerninterner Personalverleih – Beurteilung der Bewilligungspflicht / Weisung 2017; Präzisierung der Weisungen und Erläuterungen zum AVG). In this guideline, SECO clarifies its original guideline of 2003 with respect to the licensing requirements of intra-group hiring of services, stating that as a matter of principle, (also) intra-group hiring of services requires a license.
